Who can register as unemployed

To obtain the status of an unemployed person, a foreigner must hold one of the residence titles specified in the act — among others a permanent residence permit, temporary residence for a family member of a Polish citizen, a temporary residence and work permit, or a visa issued for the purpose of work.

Important: registration itself (the status of an unemployed or job-seeking person) is different from the right to a benefit. Registration gives access to labour-market services even without the right to the benefit.

The right to the benefit arises after proving at least 365 days of work with contributions paid to the Labour Fund within the 18 months immediately before the date of registration (alongside other conditions, e.g. the absence of a suitable job offer).

How much and for how long

The amount of the benefit depends on the service period (a correspondingly lower, basic or higher rate), and the payment period (e.g. 180 or 365 days) — on the situation in the local labour market and individual circumstances. Exact amounts and periods are set on the basis of the applicable rules and require checking for a specific case.

Even without the right to the benefit it is worth registering. After registration a foreigner can use job placement, career counselling, help in actively seeking work and training organised by the labour office.

What the 2025 Act changed

Since 1 June 2025 the new Act of 20 March 2025 on the labour market and employment services has been in force, replacing the employment promotion act that had been in effect for over 20 years. It introduces, among others, an ordered catalogue of forms of assistance (benefits, scholarships, training, internships, loans). The detailed conditions for foreigners are worth confirming under the new rules.
