The 10 most common errors in a MOS application — and how not to lose your legal stay because of them

An electronic application in MOS does not forgive carelessness. Formal deficiencies mean a summons to supplement them, and in the worst scenario — leaving the application without examination, that is a situation in which the case is not pending at all and the legality of your stay hangs by a thread. Here are the errors we see most often in the firm's practice.

1. Filing the application after the legal stay has expired

An application filed even one day after the legal stay (visa, visa-free travel, previous card) has expired does not produce the „legalising” effect of awaiting a decision and exposes you to a return obligation.

✓ File the application at the latest on the last day of your legal stay — the UPO from MOS confirms the date.

2. Missing electronic signature or an error when signing

An application that is completed but unsigned (or signed incorrectly) has not been effectively filed.

✓ After sending, always download and keep the UPO. No UPO = no proof of filing.

3. Missing annex no. 1 from the employer (single permit)

The employer must electronically sign annex no. 1 via a link received by e-mail. An unaware employer who ignores the message blocks the entire case.

✓ Warn your employer in advance and verify that they signed the annex before the deadline.

4. Illegible or incomplete scans

Cropped passport pages, illegible contracts, a photo that does not meet the requirements — these are classic reasons for summonses to supplement the file.

✓ Scan every used page of your passport in good resolution; check each file before sending.

5. Data discrepancies (transliteration, dates, numbers)

A different spelling of your surname in the passport, the PESEL register and the employment contract raises doubts at the office and prolongs the proceedings.

✓ Unify the spelling in all documents in line with the passport — before you file the application.

6. No stamp duty paid or the wrong office account

✓ Pay the correct amount to the account of the city office competent for the voivode's seat and attach the confirmation.

7. Wrong type of permit

Choosing the wrong residence basis (e.g. „work” instead of „business activity”, an ordinary temporary residence instead of the EU Blue Card) means, at best, the loss of months.

✓ In an atypical situation (change of employer, own business, family) consult the choice of procedure with a lawyer.

8. Outdated address for service and failure to collect correspondence

Summonses served to an old address (or electronically but not read) are deemed served — the time limits run.

✓ Update your address, regularly check your MOS account and your e-mail inbox.

9. Missing the deadline to supplement deficiencies

The office sets a time limit (usually at least 7 days) to supplement formal deficiencies. Exceeding it = leaving the application without examination.

✓ React immediately; if you need more time, file a request to extend the deadline before it expires.

10. Failure to appear for biometrics

Fingerprints are essential for the card to be issued. Ignoring the summons halts the case.

✓ Appear when summoned, with your passport; if the date clashes — request a change in advance.

Leaving without examination — what does it mean? The office does not issue a refusal decision, it simply does not examine the case at all. There is no ordinary appeal against it, and the „waiting” period does not legalise your stay. Often the only way out is a new application — provided your stay is still legal.
